Liability Waiver

I understand that the required physical exertion may be strenuous and cause physical injury, and I am fully aware of the risks and hazards involved. I hereby represent that myself and/or my child is physically fit to receive and participate in the prescribed course of instruction and usage of the equipment and facilities of The Ninja Gym including use of the indoor facility, mobile ninja warrior course and events. I acknowledge that I have been advised to consult my my physician and my child’s physician prior to and regarding mine and/or his/her participation in usage and that my physician/my child's physician has confirmed to me that I and my child has no medical condition which would affect mine or his/her full participation in the usage of the The Ninja Gym indoor facility, mobile ninja warrior course and events.

In consideration of my and/or my child being permitted to participate in exercise activity, I for myself, my heirs, executors, administrators, successors, assigns and anyone else who may claim on my behalf hereby waive any and all claims, liability and damages I may now or in the future have against The Ninja Gym, their directors, officers, instructors and staff and all persons acting under its authority and their respective heirs, executors, administrators, successors, and assigns, arising by any means whatsoever, including, but not limited to death, injury, damages to or loss to my person, my child or property of any kind whatsoever, no matter how caused arising from or in connection with mine or my child’s participation in the facility, however caused.

I further hereby release, remiss and forever discharge The Ninja Gym, their directors, officers, instructors and staff and all persons acting under its authority and their respective heirs, executors, administrators, successors, and assigns from and against all demands, claims, actions, damages, costs and expenses arising from or with respect to death, injury, damages to or loss to myself, my child or my property of any kind whatsoever, no matter how caused, arising from or in connection with my participation at The Ninja Gym whether or not caused by, in whole or in part, the negligence or gross negligence of The Ninja Gym.

I will hold harmless and indemnify The Ninja Gym, their directors, officers, instructors and staff and all persons acting under its authority and their respective heirs, executors, administrators, successors, and assigns from any and all liability for any damage or injury to the property or persons of any third party resulting from my or my child's involvement in or presence at The Ninja Gym.

Media Waiver

I understand The Ninja Gym and its staff commonly will record events and take pictures and videos of participants, classes, events and parties through the use of recording devices and cameras. I hereby give my consent for The Ninja Gym and its staff to use photographs and video recordings of myself and my child and the likeness to be used in promotion, sales, publicity and advertising purposes for all media, including, but not limited to, the internet. I release them from any expectation of confidentiality or payment for my photographs and videos

Rules

As a participant or guardian of a participant, I agree to uphold the below The Ninja Gym rules as well as support The Ninja Gym staff in upholding these rules.

Participants 4 and under must be accompanied by an adult.
Participants must sign a The Ninja Gym liability waiver to use the indoor facility or mobile course.
Participants must abide by The Ninja Gym staff directions.
No climbing on the trusses or using the obstacles outside of their intended use.
No pushing, shoving, or roughhousing on the The Ninja Gym equipment.
Participants must keep a proper distance between each other on the course. No piggy backs, or back-to-back runs.
The Ninja Gym reserves the right to prohibit individuals from using the equipment if they feel it puts the person at significant risk. Examples include: if the individual is intoxicated, if the individual is pregnant, if the individual has a broken limb, etc.
