CrossFit Cedar Grove, LLC, Waiver, Release, Code of Conduct
I fully understand and acknowledge that all of my children (under the age of 18 years old) and/or any adults, family, or other persons under my care that may participate at any time, for any program, are included under this Release of Liability Waiver even if their name is not on the Waiver Form at this time. It will be my responsibility to inform them of the following information. This is also valid for any event whatsoever on the premeses or affiliated with CrossFit Cedar Grove, Limitless Performance and Therapy, or West Essex Barbell Club.
Recreational, therapeutic, and fitness activities, have (a) inherent risk, dangers, and hazards and such exists in my use of any equipment and my participation in these activities; (b) my participation in such activities and/or use of such equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that, could cause serious disability; (c) these risks and dangers may be caused by the negligence of the representatives, employees, or volunteers of , CrossFit Cedar Grove, LLC. (“The Facility”), the negligence of the participants, the negligence of others, accidents, breaches of contract, or other causes; (d) by my participation in these activities and for use of equipment, I hereby assume all risks and dangers and all responsibility for any losses and/or damages whether caused in whole or in part by the negligence or the conduct of the representatives, employees, or volunteers of The Facility, or by any other person. I, on behalf of myself, my personal representatives and my heirs, hereby voluntarily agree to release, waive, discharge, hold harmless, defend, and indemnify The Facility and it representatives, employees, and volunteers from any and all claims, actions or losses of bodily injury, property damage, wrongful death, losses of services or otherwise which may arise out of my use of any equipment or participation in these activities. I specifically understand that I am releasing, discharging, and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by the representatives, employees, and volunteers of The Facility.
I do hereby further declare myself to be physically sound and suffering from no condition impairment, disease, infirmity, or other illness that would prevent my participation in programs or use of the equipment or machinery except hereafter stated. I acknowledge that I have no physical impairments, injuries, or illnesses that will endanger me or others.
Express assumption of risk: I am aware that there are significant risks involved in all aspects of physical training. These risks include but are not limited to: falls which can result in serious injury or death; injury or death due to negligence on the part of myself, my training partner, or other people around me; injury or death due to improper use or failure of equipment; strains and sprains. I am aware that any of these above mentioned risks may result in serious injury or death to myself and or my partner(s). I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participation in any activity or class while at, or under direction of CrossFit Cedar Grove, LLC.
Release: In consideration of the above mentioned risks and hazards and in consideration of the fact that I am willingly and voluntarily participating in the activities offered by CrossFit Cedar Grove, LLC. , I, the undersigned hereby release CrossFit Cedar Grove, LLC. , their principals, agents, employees, and volunteers from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my participation in this activity, including those allegedly attributed to the negligent acts or omissions of the above mentioned parties. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect.
If I am signing on behalf of a minor child, I also give full permission for any person connected with CrossFit Cedar Grove, LLC. to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and or surgical care for the child and to transport the child to a medical facility deemed necessary for the well-being of the child.
Indemnification: The participant recognizes that there is risk involved in the types of activities offered by CrossFit Cedar Grove, LLC. Therefore, the participant accepts financial responsibility for any injury that the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above-mentioned parties, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless CrossFit Cedar Grove, LLC. , their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by CrossFit Cedar Grove, LLC. , at the main building or abroad. This includes but is not limited to parks, recreational areas, playgrounds, areas adjacent to main building, and/or any area selected for training by CrossFit Cedar Grove, LLC.
Participants involved in any activities offered by CrossFit Cedar Grove, LLC. may be photographed or videotaped during training. The undersigned hereby consents to the use of these photographs and/or videos without compensation, on the CrossFit Cedar Grove, LLC. website or in any editorial, promotional or advertising material produced and/or published by CrossFit Cedar Grove, LLC. Participants agreed not to publicly disparage CrossFit Cedar Grove, LLC. by posting libelous information on any social media site, service, or platform, including but not limited to Facebook, Instagram, Twitter, LinkedIn, Snapchat, with intent to maliciously defame.
I have read and understood the foregoing assumption of risk, and release of liability and I understand that by checking/signing it obligates me to indemnify the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission. I understand that by signing this form I am waiving valuable legal rights.
All sales are final at time of sale. No returns no refunds.
The following Code of Conduct is applicable to all and has no exceptions. Participation in any service from CrossFit Cedar Grove, LLC, is deemed as acceptance to being bound by this full Code of Conduct:
All members, clients, and guests must sign in for each and every class prior to attending. Failure to sign in may result in refusal from admittance to class as well as additional administrative fees of $5 per incident.
All members, clients and guests must follow direction from all staff, directors, coaches of CrossFit Cedar Grove, LLC, at all times with no exceptions.
All members, clients and guests must conduct themselves in a friendly and polite manner. Intimidation, discrimination, harassment (including sexual), blackmailing and general bullying towards any individual will not tolerated.
Any forms of aggression or pursuit including, verbal, sexual or physical assault to any individual is considered extreme misconduct and immediate expulsion may be imposed.
No member, client or guest shall make fellow members, clients, guests or staff feel intentionally uncomfortable or intimidated at any time.
At no time are members, clients or guests to coach other members, clients and guests with technical advice. This is for CrossFit Cedar Grove, LLC, employed coaches only.
It is required to wipe up sweat, chalk, and put away equipment after you have finished your workout to ensure a safe environment for others.
For personal safety and safety to others do not leave any equipment on floor when not being used in your workout.
No intoxicated members, clients and guests are permitted to train. This includes alcohol, drugs or anything else that inhibits a person’s judgement.
All members, clients and guests must respect the rights of all participants regardless of their gender, sexual orientation, ability, cultural background or religion.
Dogs. Should you bring your dog to the gym, you expressly assume all liability for it’s behavior and fully indemnify and hold harmless CrossFit Cedar Grove, LLC, and all of it’s associates. Dogs must be leashed or tethered at all times. Dogs must be supervised at all times by the owner. Dogs must be up to date on all vaccinations. Owners must clean up accidents. Dogs unfriendly to people or other dogs are not permitted. I understand that there can be dogs at the facility and I assume the risk of any injuries that may happen as the result of dogs and I fully indemnify and hold harmless CrossFit Cedar Grove, LLC, and all of its staff and coaches, should such injuries occur.
Children. All children you bring into the facility are your sole responsibility and you expressly assume all liability for their behavior and fully indemnify and hold harmless CrossFit Cedar Grove, LLC, and all of its associates. Children must be outside of main workout areas and under parent/guardian supervision at times. Staff and coaches reserve the right to intervene during any situation deemed potentially unsafe, up to and including removing the child.
Staff, and coaches reserve the right to refuse entry to any member, client or guest in breach of the above conditions. Members, clients or guests in breach of these conditions may have their membership or service terminated and be barred from the facility without prior notice.
